WAIVER AND RELEASE AGREEMENT

I, on behalf of myself, heirs, and/or assigns, assume all risk of accident, and agree that neither the  St. Croix Yacht Club, nor any of its officers, directors, members, employees, agents, servants, or representatives, shall be liable, under any circumstances, nor bear any responsibility for any loss of life or injury to property or persons which may occur, however caused, before, during, or after the sailing instructional program session, regatta or other event. I, on behalf of myself, my family, my children, heirs, and assigns, hereby voluntarily release, discharge, waive, and relinquish any and all claims actions and/or causes of action for personal injury, property damage or wrongful death against the St. Croix Yacht Club occurring as a result of engaging in said activities, for whatever period said activities may continue, regardless of whether or not due in whole or any part to any act, omission, or negligence of the St. Croix Yacht Club, and/or its officers, directors, members, employees, agents, servants,  or representatives, or by any other person, notwithstanding and regardless of the Virgin Islands Comparative Negligence Statute, Title 5, V.I.C. 81451.

I, acknowledge that I have read the foregoing paragraph, and have been fully and completely advised of the potential danger incidental to engaging in the activity and am fully aware of the legal consequences of this agreement.
